  • Employers who opt to join a group-experience-rating program receive a premium discount-potentially up to 53% effective their FIRST day of coverage.
  • Those employers who do not join a group, can receive up to a 25% discount on their workers' compensation premiums.

Did you recently receive a white envelope from BWC labeled "important documents enclosed." That's your rebate check and it's important to get it cashed quickly because it will expire in 90 days.

 BWC is delivering the checks as part of a $1.5 billion rebate announced this spring. The rebate brings workers' comp savings for all Ohio employers to $8 billion since 2011. 

If you haven't received a check but believe you should, please check your mail again and then contact BWC for an update on its status.

While the money is yours to spend as you wish, we encourage employers to invest in workplace safety measures that prevent injuries and reduce workers' comp costs. 

If you participate in the Group Retrospective Rating Program, your check will arrive in October.

The Law Has Changed!

Motor Vehicle Accident Update

Since September of 2016, the Bureau of Workers' Compensation has excluded the cost of a claim from an employer's experience if the employer could establish that a claim resulted from a non-at-fault motor vehicle accident involving a third party.

In order for the BWC to charge such claims to the Surplus Fund, employers have been required to provide proof that the at-fault third party was issued a citation for violation of a motor vehicle law. Due to a recent change in the law, employers are no longer required to submit proof of a citation with an AC-28 application.

As of September 13, 2018, employers can request relief for motor vehicle accidents even where the at-fault, third party was not issued a citation. See R.C. § 4123.932. As long as there is other documentation to demonstrate that the third party was primarily liable for the accident, employers can submit a request to charge the Surplus Fund without having to provide a citation.

AC-28 applications will no longer be denied solely because no citation was issued to the at-fault third party. The law applies retroactively to claims occurring on or after July 1, 2017. The BWC is also accepting applications from employers where an AC-28 was previously denied.

Any employer that incurred a claim during the GREEN period and is currently participating in a WORKERS' COMPENSATION GROUP RATING PROGRAM, must complete 2 hours of safety training to be compliant with Ohio BWC guidelines. 

 Private Employer green year:
July 1, 2016- September 30, 2017

Public Employer green year:
**January 1, 2017 - March 31, 2017** 

 There are a number of options available for completing this requirement, employers can:

  • Attend a training session provided by the BWC's Division of Safety & Hygiene

    Dates, times, and locations

  • Complete the BWC's online Accident Analysis course and the corresponding report.
